BIM Object License Agreement

This BIM Object License Agreement is issued by  – Fornacis France - trading as Pam Building, 130 Impasse du Chêne - 54700 BOUXIERES-SOUS-FROIDMONT, France, SAS au capital de 6 812 970,75€ SIREN 799 283 882 RCS NANCY (hereinafter referred to as the Licensor),

To any person or organization downloading the BIM Object (hereinafter referred to as the Licensee).

Important Notice – Please Read Carefully

By downloading, installing, copying, or using a BIM Object from the Pam Building BIM Library, you agree to comply with the terms of this License Agreement and the related disclaimer provisions.

Your acceptance of this agreement is legally binding, just like a signed contract.
If you do not agree to these terms, you must immediately stop using the BIM Object and delete all copies in your possession.

1. Definitions

  • BIM Object: any digital model made available in its current version on Pam Building BIM Library, including related documentation, electronic files, or associated media.
  • Use: any action such as downloading, installing, copying, or otherwise benefiting from the BIM Object’s intended functionalities.

2. Purpose of the Agreement

The goal of this agreement is to define the conditions under which the Licensor grants the Licensee a personal, non-exclusive, and non-transferable right to use the BIM Object for professional purposes.

The Licensee may use the BIM Object on one or multiple workstations for design, construction, or architectural applications.

3. License Rights and Restrictions

Authorized Usage:

  • Install and use the BIM Object on one or more computers.
  • Create one or more backup copies, provided all copyright and proprietary notices are preserved.

Prohibited Actions:

  • Reproduce or distribute the BIM Object beyond the rights granted.
  • Modify, translate, or adapt the BIM Object without prior written consent from the Licensor.
  • Reverse engineer, disassemble, or decompile the BIM Object to develop derivative works.

4. Updates and New Versions

Pam Building may release updated versions of the BIM Object. Each new version replaces the previous one and remains subject to this agreement.
It is the Licensee’s responsibility to ensure they are using the most recent version available.

5. Duration of the License

Unless terminated earlier under Article 10, this license remains valid for the full legal duration of copyright protection applicable to the BIM Object.

6. Intellectual Property Rights

The BIM Object is the exclusive property of Pam Building and is protected by copyright laws and international conventions.

Any infringement may constitute copyright violation, subject to penalties under French law (up to three years imprisonment and a €300,000 fine).

The Licensee must notify the Licensor of any infringement they become aware of.

7. Disclaimer of Warranty

The BIM Object is provided “as is”, without any express or implied warranty.
The Licensor does not guarantee compatibility with the Licensee’s systems or that it will function error-free under their hardware and software environment.

8. Limitation of Liability

To the maximum extent permitted by law, the Licensor shall not be held liable for:

  • data loss or corruption,
  • business or financial damages,
  • inability to use the BIM Object,
    even if the Licensor was informed of possible risks.

The 3D modeling provided is an approximate digital representation of a real product. Differences between the model and the physical product may exist, and the Licensor cannot be held responsible for such discrepancies.

9. Entire Agreement and Severability

This document represents the entire agreement between the parties.
Any modification must be in writing and signed by both parties.
If one provision is deemed invalid, the rest of the agreement remains enforceable.

10. Termination of the License

Any breach of these terms will result in automatic termination of this license.
Upon termination, the Licensee must destroy all copies of the BIM Object.

11. Non-Transferability

This license is personal (intuitu personae), non-transferable, and cannot be sublicensed.

12. Governing Law

This agreement is governed by French law, regardless of conflict-of-law principles.

13. Dispute Resolution

In case of dispute, the parties will first attempt to reach an amicable settlement.
Failing this, French courts will have exclusive jurisdiction.

14. Language

The official language of this license agreement is French. In case of conflict between versions, the French text shall prevail.
